1. General provisions

1.1. This User Agreement (hereinafter - the Agreement) regulates the legal relationship between the administration ("Trident", hereinafter - "Administration") of the 3zub.net portal (hereinafter - the Portal and/or Site) and an individual (hereinafter - the User) when using forums, blogs, chat, comments and other interactive resources, as well as placing text messages, video, audio, graphic materials, (hereinafter - Materials) on the Site on the Internet at https://3zub.net/ (hereinafter - the Site), as well as sending postal messages using Postal services (e-mail).

A user is a natural person who has registered on the site and uses the services and/or online products of the 3zub.net portal. The text of this Agreement is displayed to the User upon registration. The Agreement enters into force from the moment the User agrees to its terms by registering on the Site. The user can use the services of the Site only after registration.

1.2. This Agreement may be changed by the Administration without any special notification to the User. The new edition of the Agreement enters into force from the moment of its posting on the portal.

1.3. Legal relations arising between the User and the Administration in connection with the execution of this Agreement are governed by the legislation of Ukraine.

2. Interaction

2.1. The Site provides Users with online services (forums, blogs, chats, commenting function and other interactive resources (hereinafter referred to as the Service), the possibility of posting their Materials and using e-mail on a free basis.

2.2. In order to use the e-mail functions and Portal Services, the User must go through the following registration procedure:

2.2.1. Fill out the registration form;

2.2.2. Express agreement with the terms of this Agreement. At the same time, the Administration does not in any way check the information provided by the User for truthfulness and is not responsible to any third parties for the accuracy and truthfulness of such information; does not regard the information provided by the User as personal data subject to special protection in accordance with the Law of Ukraine "On the Protection of Personal Data";

2.2.3. Upon completion of the registration process, the User enters the account login and password to access e-mail and Portal Services. The User is personally responsible for the security of his login and password, as well as full responsibility for all actions that will be performed by the User in the process of using e-mail and Portal services;

2.2.4. The User agrees that the Administration has the right to collect and store the User's registration data (if received) within the Service in order to fulfill the provisions of this Agreement.

2.3. The postal service of the Site bears no responsibility for the compliance of the Service with the User's goals, for the delay, deletion or non-delivery of mail.

2.4. All issues of granting access rights to the Internet, purchasing and debugging for this relevant equipment and software are decided by the User independently and are not subject to the scope of this Agreement.

2.5. The User's password for e-mail and services of the 3zub.net portal can be restored by the Administration only in case of accurate, correct and complete entry of the information specified during the initial registration of the account by the User.

2.6. The Administration does not exercise any control and is not responsible for the content of the Users' correspondence, except for cases provided for by the legislation of Ukraine.

2.7. Posting of Materials and use of the Services are post-moderated, that is, the moderator gets acquainted with the materials after the User has posted such materials on the Site. If any material violates the rules of use of the Site and/or is such and/or contains information that contradicts the requirements of current legislation, such material is subject to removal.

3. Services (Posting Materials)

3.1. The User places his Materials on the Site, and also transfers to the Administration the exclusive right to provide wide access to the Materials within the limits of this resource without payment of any remuneration.

3.2. The user is aware and agrees that e-mail may contain official messages of the Administration, automatic messages and newsletters, and that such messages are a necessary condition for its use.

3.3. The User agrees that the Administration has the right to place advertising banners and announcements on the pages containing the User's Materials, to modify the Materials for the purpose of placing advertisements.

3.4. Responsibility for unauthorized copying and use of the Materials is borne by all and any legal entities and individuals who illegally used the Materials posted on the Site.

3.5. Until otherwise established, all property and personal non-property rights to the Material belong to the User who posted them. The user is warned about the responsibility established by the current legislation of Ukraine for the illegal use and placement of other people's materials (works). In case it is established that the User 

the user who posted the Materials is not their legal right holder, these Materials will be removed from free access at the first request of the legal right owner.

3.6. When posting the Material, the Administration indicates the User's nickname (nickname), specified by the User when providing the Material.

3.7. Materials placed on the Site must not contain:

materials that are illegal, harmful, threatening, offensive to morality, honor and dignity, rights and legally protected interests of third parties, defamatory, infringing copyright, promoting hatred and/or discrimination of people based on race, ethnicity, gender, social signs that contribute to the incitement of religious, racial or ethnic enmity, scenes containing violence, or inhumane treatment of animals, etc., established by the Law of Ukraine "On Morality", the Constitution of Ukraine and other relevant regulatory acts;

restriction of minority rights;

impersonating another person or a representative of an organization and/or community without sufficient rights, including employees and owners of the Administration, as well as misleading about the qualities and characteristics of some subjects or objects;

materials that the User does not have the right to make available by law or according to some contractual relationship;

materials that infringe the rights to any patent, trademark, trade secret, copyright or other property rights and/or copyright and related rights of a third party;

it is prohibited to: upload, post or transmit in any other way intrusive advertising, "spam" correspondence, "letters of happiness", invitations to participate in financial pyramids or impose services in any other way;

materials containing computer codes designed to disrupt, destroy or limit the functionality of any computer or telecommunications equipment or programs, to carry out unauthorized access, as well as serial numbers to commercial software products, logins, passwords and other means of obtaining unauthorized access to paid resources on the Internet;

intentional and/or accidental violation of any applicable local, state or international laws;

collection and storage of personal data of other users;

unauthorized transfer of records of an advertising, commercial or campaigning nature;

advertising of narcotics;

posts to anyone's address containing rude and offensive expressions and suggestions;

records containing materials of a pornographic nature.

it is forbidden to have more than one account (clone) if the rules of the site are violated or the rating is cheated. In case of violation of the agreement, the account will be banned (removed) without any warning.

3.8. The user understands and accepts that all information, data, text, programs, music, sounds, photos, graphics, videos, messages and other materials posted for public access or transferred privately are the responsibility of the person who made this posting.

3.9. The User may not download, transmit or publish the Materials, if they were not created personally by the User or for which the User does not have the permission of the relevant right holder to post them.

3.10. In case of receiving claims from third parties related to posting of materials by the User, the User shall independently and at his own expense settle said claims.

3.11. The user alone bears full responsibility for the content of his/her mail messages sent via the Site's e-mail.

3.12. Using the mail service bigmir.net, it is prohibited to mass send commercial, political and other advertisements or other types of messages (information) to persons who have not expressed a desire to receive them (spam).

4. Account Termination and Removal of User Materials

4.1. The User agrees that the Administration reserves the right to terminate the User's account and/or block the User's access to the Site, at any time without prior notice to the User and without specifying the reason, in the following cases:

4.1.1. Violation of the provisions of this Agreement, its parts and additions;

4.1.2. According to the relevant record of state authorities, in accordance with current legislation;

4.1.3. Long-term non-use (from 6 consecutive calendar months) of the account to access the site;

4.1.4. In other cases, if the Administration considers such deletion necessary for the normal operation of the Site.

4.2. The User can request the Administration to deactivate his account on the Site. Deactivation should be understood as the temporary blocking of the user's account with its preservation (without deleting the user's information from the Site's database). To deactivate the account, the User must write a letter to the Site's support service from the mailbox where the User's account was registered, with a request to deactivate the account.

4.3. To restore registration on the Site (account activation), the User must write a letter to the Site support service with a request to activate the account 

nt of the User, from the mailbox to which the User's account was registered.

4.4. The Administration reserves the right at its own discretion to change (moderate) or delete any information published by the User, including information (materials) that violates the prohibitions set forth in clause 3.7. of the current User Agreement (as well as any other prohibitions and requirements stipulated by the current legislation of Ukraine), including personal messages and comments, with or without prior notice, without being responsible for any damage that may be caused to the User by such an action.

4.5. In the event that the User posts Materials that do not belong to him, and the right holder receives a reasoned complaint about the violation of his rights protected by law, the Administration has the right to remove the content posted by the User or block access to it by Users without notifying the User and without explaining the reasons.

5. Rights and obligations

5.1. The Administration tries to ensure uninterrupted operation of the Site, but is not responsible for the complete or partial loss of Materials posted by the User, as well as for the insufficient quality or speed of providing Services.

5.2. The user has the right to use the Site to place intellectual property objects, the right to use of which belongs to him on legal grounds.

5.3. The Administration has the right to refuse the User to post Materials, text messages, as well as to remove Materials at its discretion, if their content contradicts the requirements of this Agreement.

5.4. The User agrees that he bears full responsibility for the content of his mail messages, as well as for the Materials placed by him on the Portal. The Administration is not responsible for the content of the Materials and their compliance with the requirements of the law, for copyright infringement, unauthorized use of signs for goods and services (trademarks), company names and their logos, as well as for possible violations of the rights of third parties in connection with placing Materials on the Site. In case of receiving claims from third parties related to the placement of Materials, the User settles these claims independently and at his own expense.

5.5. The User grants the Administration a non-exclusive license for use, including reproduction, distribution, processing, public display of bigmir.net and making public the materials posted by the User within the portal for public viewing as Site content. The user, who is the legal author of the materials specified in this paragraph, retains all property and personal non-property copyrights, in accordance with the legislation of Ukraine and international agreements.

5.6. The User agrees not to reproduce, repeat or copy, sell or resell, and also not to use for any commercial purposes any objects of intellectual property posted on the Site, except when such right is granted by its legal Right Owner.

5.7. The administration does not guarantee that the site's services will meet the User's requirements; will be provided continuously, quickly, reliably and without errors, and the results that may be obtained by the User will be accurate and reliable.

5.8. Any materials obtained by the User using the services of the Site are used by the User at his own peril and risk. The user is solely responsible for any damage that may be caused to the computer and/or data as a result of downloading and using these materials.

5.9. The Administration undertakes to inform the User about claims of third parties on the Materials posted by the User. The User undertakes to either grant the Administration the right to publish the Material, or remove the Material.

5.10. The Administration has the right at the first request of the relevant authorized (law enforcement) body, but in accordance with the current legislation, to provide such state body with available information about the User, not excluding personal data.

5.11. The User acknowledges that the Administration may set restrictions on the use of services and mail, including: the storage period of postal messages and any other materials posted by the User, the maximum number of messages that can be sent or received by one User, the maximum size of a postal message or disk space.

5.12. If a person performing actions that qualify as spam on the Portal's mail is detected, the Administration has the right to block the receipt of mail messages from the mail address of the specified person (including Users) to the Site's mail addresses. In addition, the Administration has the right to apply to law enforcement agencies for prosecution for such actions.

5.13. The administration is not responsible for:

for the User's actions on the Site;

for failures occurring in telecommunication and/or energy networks, the operation of malicious programs, as well as for dishonest actions of third parties;

for the content and legality of the Information used/received 

by the User within the Service, as well as for its nature;

for damage/lost profit caused to the User as a result of using or not being able to use this or that service;

for the reliability of advertising information received by the User as part of the service, and the quality of the goods/services advertised in it, etc.;

for certain damages to the User's software and/or hardware complex that occurred as a result of using the service.

6. General information

6.1. This Agreement is legally binding on both the Administration and the User.

6.2. The User has the right to refuse to accept changes and additions to the Agreement made by the Administration, which means the User's refusal to use the Site's services.

6.3. All possible disputes arising in connection with/about the execution of this Agreement are allowed in accordance with the norms of the current legislation of Ukraine.

6.4. Nothing in the Agreement can be understood as the establishment between the User and the Administration of agency relations, partnership relations, joint activity relations, personal employment relations, or any other legal relations not expressly provided for in this Agreement.

6.5. A user who believes that his rights and interests have been violated due to the actions of the Administration or third parties in connection with the posting of any Material on the Site, sends a claim to the support service. The material will be immediately removed from free access at the first request of the rightful owner.

6.6. In the case of the adoption of regulatory legal acts by the authorities of Ukraine, which affect fully or partially the functioning of the Site or Services, the Administration reserves the right to make any changes in the functioning of the Services, aimed at bringing the Site's activity into compliance with the new norms.

Rules for conducting contests on the Site

Terms:

1. The current rules for conducting contests https://3zub.net/ (hereinafter - Rules) are designed to determine the general conditions for holding contests (hereinafter - Contests). Individual features of the competition are defined in each competition separately.

2. The organizer of the Contest is the administrator of the website https://3zub.net/ "Trizub" (hereinafter - the Organizer).

3. The Organizer creates an Organizing Committee (hereinafter referred to as the Organizing Committee) to conduct the Competition and sum up the results. In its actions, the Organizing Committee is guided by the current legislation of Ukraine and the current Rules and is responsible for their compliance.

4. Contest participants (hereinafter - Contest Participants or Participants) are citizens of Ukraine over the age of 14 who are not employees of the Organizer, their relatives and/or employees of affiliated (related) persons of the Organizer.

5. Participation in the Competition means that the Participant has familiarized himself with the Rules and agrees with their conditions.

Procedure for determining winners and awarding prizes:

6. The final winners will be determined at the meeting of the Organizing Committee according to the conditions of victory in each specific competition. According to the results of the meeting of the Organizing Committee, a protocol containing the names of the winners is drawn up. The protocol is signed by the chairman and members of the Organizing Committee.

7. The date of receipt of the prize is determined in the conditions of each competition.

8. The organizer reserves the right to publish additional information about the Contest, to change the terms of the Contest and to change the terms of the Contest, provided that the Participants are notified of such changes. Notification is carried out by placing information on the website.

9. Receiving a prize by the winner means receiving a prize at the price of 1 (one) hryvnia including VAT. Funds are transferred to the following bank details.

10. Contest participants who have acquired the right to receive prizes cannot receive their equivalent in another form. Prizes cannot be exchanged or returned.

11. Persons who will receive the right to receive prizes must provide as specified in clause 1.2. of these Rules to the address of a copy of the documents: passport data (passport copy), identification code (copy of the relevant certificate) of the participant or one of the participant's parents. If the data is not provided or is not provided in full by the final date of receipt of the prize, such Participant loses the right to receive the prize.

12. By participating in the contest, all participants agree that their names and photos may be announced and used by the Organizer or third parties (upon agreement with the Organizer), without any time limits, in print media and on the Internet, and such use is free of charge and is not compensated in any way (such use is possible, including for advertising purposes).

13. The Organizer is not responsible for the inability of the Participants to receive and use the prizes due to their lack of necessary documents; for other reasons.

14. In the event of a situation involving an ambiguous interpretation of the Rules, any disputed issues and/or other issues not regulated by the Rules, the final decision is taken by the Organizer.

15. To remove your account from the site!

You need to go to your account settings, the "General Settings" item.
Select "Delete account".
When asked, "Are you sure you want to delete your account?" you need to select "Yes" and click "Confirm".
After that, all your data (Name, Surname, e-mail, phone number, your address) will be irrevocably deleted from the site!
